Responsibilities
- Review and evaluate high-volume third-party subpoenas seeking patient diagnostic imaging records in personal injury matters.
- Draft and file timely objections to subpoenas that are legally defective, procedurally improper, or otherwise invalid, including overbroad or disproportionate discovery requests.
- Ensure subpoena responses comply with applicable state and federal laws, including HIPAA, state privacy statutes, and civil procedure rules.
- Develop and maintain standardised objection templates and response protocols to support consistent, efficient handling across a high-volume docket.
- Manage requests for depositions of Scan.com personnel, including corporate representative depositions, and prepare and coach deponents on topics, anticipated questions, and company policies.
- Partner closely with the medical records team to understand record-keeping systems, locate responsive documents, and ensure accurate, timely production where required.
- Correspond directly with plaintiff and defence attorneys to negotiate subpoena scope, resolve disputes, and manage deadlines.
- Supervise and delegate work to a dedicated paralegal, providing direction and oversight on day-to-day subpoena workflow management.
- Advise internal teams on the legal implications of subpoena requests and contribute to refining internal legal policies and procedures related to records requests and subpoena management.
- Stay current on developments in personal injury litigation, discovery law, and health records privacy regulations in relevant jurisdictions.
Requirements
- Juris Doctor (J.D.) from an ABA-accredited law school.
- Active bar licence in Georgia (or eligible for admission on motion); admission in additional states is a plus.
- Substantial litigation experience with a meaningful focus on personal injury matters.
- Demonstrated experience handling third-party subpoenas, including drafting objections and managing subpoena response workflows.
- Strong knowledge of Georgia civil procedure rules and the federal rules governing third-party discovery.
- Thorough understanding of Georgia tort reform and its implications for personal injury litigation, including damages caps, apportionment of fault, and evidentiary standards.
- Proven ability to manage a high-volume docket while maintaining attention to detail and meeting strict deadlines.
- Excellent written and oral communication skills, including direct experience corresponding with opposing counsel.
- Experience preparing and defending witnesses for depositions.
Nice to Have
- Prior in-house legal experience in a healthcare, health-tech, or medical records environment is a plus.
- Familiarity with HIPAA and other health information privacy regulations as applied to litigation and subpoena response.
- Prior experience supervising or mentoring paralegals or junior legal staff.
