As Employment Counsel for Mainland China and Hong Kong, you will serve as the principal legal advisor on employment matters within a high-growth fintech organization. Reporting to the Associate Director, Employment Legal, you will operate independently to support HR and business leaders with practical, legally sound solutions in a rapidly evolving regulatory landscape.
Key Responsibilities
- Lead and manage internal investigations into workplace misconduct, from planning and interviews to evidence assessment and final reporting, ensuring outcomes are well-documented and defensible in arbitration or litigation.
- Handle labor arbitration and employment-related legal proceedings in Mainland China, and support dispute resolution in Hong Kong, including strategy development, evidence gathering, hearing preparation, settlement discussions, and coordination with outside counsel.
- Provide timely legal advice on day-to-day employment issues such as hiring, performance management, disciplinary actions, terminations, restructurings, compensation structures, and compliance with local employment handbooks under PRC and Hong Kong law.
- Develop, review, and update employment agreements, separation documents, policies, and employee handbooks to align with current regulations and organizational risk standards in both jurisdictions.
- Design and deliver training programs for HR and management on employment law topics, including investigations, disciplinary procedures, and termination protocols, to strengthen internal capabilities and reduce legal exposure.
Qualifications and Experience
- 9 to 14 years of legal experience focused on employment or labor law, with substantial work advising employers in both Mainland China and Hong Kong.
- Hold a valid PRC legal qualification (法律职业资格证) and be eligible to practice law in China.
- Demonstrated expertise in conducting workplace investigations and managing labor disputes through arbitration or litigation.
- Strong command of the PRC Labour Contract Law, Labour Law, Social Insurance Law, and Hong Kong’s Employment Ordinance and related regulations.
- Fluency in both Mandarin and English, with the ability to explain complex legal concepts clearly to non-legal stakeholders and draft official documents in both languages.
- Proven capacity to exercise sound legal judgment, work autonomously, and deliver practical, business-aligned advice under tight deadlines.
Preferred Background
- Prior in-house legal experience, especially within a technology or high-growth environment, is highly valued.
- Experience managing workforce restructurings, mass terminations, executive exits, or cross-border employment transitions.
- Familiarity with equity compensation plans, contractor arrangements, cross-border secondments, and mixed employment models.
- Ability to collaborate effectively with remote teams across time zones and build strong relationships with HR and business partners in a dynamic, fast-paced setting.
