At Toast, we build an all-in-one platform for restaurants. We are seeking a Director, FinTech Counsel, a mid-level attorney to act as the primary legal point of contact for our Embedded Finance team. You will provide transactional and regulatory support for our FinTech business line, advising on financial product design, negotiating strategic partnerships, and ensuring compliance with financial regulations.
What You'll Do
- Draft complex commercial agreements and lead negotiations with financial institutions, payment processors, strategic partners, and merchants for fintech products and services.
- Represent Legal on cross-functional teams to design and implement financial products, ensure compliance with laws and regulations, and identify creative solutions to issues.
- Research, analyze, and respond to legal questions, disputes, and escalations, advising stakeholders on legal risks and requirements for fintech solutions.
- Draft user terms and agreements such as cardholder agreements, credit agreements, and website terms of service.
- Review customer-facing materials (advertising, enablement tools, UX content) for compliance with laws and provide guidance to Marketing, Design, and Go-to-Market teams.
What We're Looking For
- J.D. from an ABA-accredited U.S. law school and membership in good standing to at least one state bar.
- Extensive experience advising fintech businesses and Director+ stakeholders on financial products and services, including embedded finance and payments solutions.
- Strong commercial drafting skills with experience independently leading negotiations within the financial services industry.
- Deep knowledge of financial laws and regulations: commercial/consumer banking regulations (Reg B, E, Z, CC, DD), consumer protection laws (UDA(A)P), electronic funds transaction laws (Reg E, NACHA), money transmitter laws, and card association rules.
- Exceptional written and verbal communication skills, with ability to distill complex legal concepts for business audiences.
- Ability to partner with product and cross-functional teams to provide legal guidance while driving business outcomes.
Nice to Have
- Experience advising on products that incorporate AI components.
Team & Environment
This is an independent contributor role reporting directly to the Assistant General Counsel, FinTech.
Benefits & Compensation
- Compensation range: $192,000—$307,000 USD.
