What You'll Do
Provide authoritative legal guidance on employment matters across Mainland China and Hong Kong, supporting HR and leadership on issues ranging from hiring and performance management to disciplinary actions, terminations, and organizational changes. Lead sensitive internal investigations into workplace misconduct, from planning and interviews to evidence analysis and final recommendations, ensuring outcomes are well-documented and defensible in arbitration or court.
Manage all stages of labor disputes in China, including arbitration and litigation strategy, evidence collection, and settlement discussions, while coordinating external counsel as needed. Support resolution of employment-related issues in Hong Kong, advising on local requirements and best practices. Draft and update employment contracts, policies, handbooks, and separation agreements to align with evolving regulations and company standards.
Deliver practical legal advice and training to HR and managers on compliance, investigations, and employee relations, helping strengthen internal capabilities and reduce organizational risk. Communicate complex legal concepts clearly to non-legal stakeholders in both English and Mandarin.
Requirements
- 9 to 14 years of experience in employment or labor law, with substantial work advising employers in both Mainland China and Hong Kong
- PRC legal qualification (法律职业资格证) and eligibility to practice law in China
- Proven experience conducting workplace investigations and managing labor arbitration or litigation on behalf of employers
- In-depth understanding of PRC Labour Contract Law, Labour Law, Social Insurance Law, and Hong Kong’s Employment Ordinance
- Fluency in Mandarin and English, both written and spoken, with strong drafting and communication skills
- Ability to exercise sound legal judgment independently, especially under tight deadlines, and deliver practical, business-focused solutions
